OHIOH.de general terms of use (“AGB”)

We would like to thank you for trusting and using OHIOH.de By being a user or using our services, you agree to the validity of these General Terms and Conditions (“GTC”). It is therefore very important that you read these terms and conditions carefully. If you do not agree with these terms and conditions, you should not use OHIOH.de and the OHIOH.de APP.
About OHIOH
OHIOH.de is a free service developed and provided by Tjark Ziehm and team for the purpose of research and support of the common good. The service is available online at ohioh.de, in the Apple App Store under “Ohioh” and in the Google Play Store under “Ohioh”. OHIOH’s purpose is to help our users collect your app data and track geodata and matches and to inform you about infection risks.
Terms of use for our services
In order to use our services, you must follow a few simple rules. The service is available for private use only and is not intended for commercial use. Do not misuse the service, so that neither ohioh.de nor others are harmed in any way. You may only use the services as permitted by law and these terms and conditions. By using our services, you agree that:
All personal information you provide is accurate and up-to-date.
you are solely responsible for the activities within your App and all content you upload and/or create at OHIOH.de (“User Data”)
OHIOH.de does not monitor the content of the Service, but may at any time, in its sole discretion, remove User Data from the Service and/or your App and terminate your account and App use.
Your use of OHIOH.de, including your email and password, is personal to you and may not be transferred to or used by others. You are responsible for keeping your access data safe. OHIOH is in no way responsible for any damage caused by unauthorised access to your APP or use of your access data. Should you have knowledge or suspicion of unauthorized use of your APP or data, you are obliged to inform the OHIOH.de team immediately. Contact information can be found at the end of this document.
OHIOH.de and APP is not intended for use by persons under 13 years of age. YOU must be at least 13 years old to use OHIOH.de or have the permission of a parent or guardian.

commercial offers, advertising and/or references (e.g. links) to where commercial offers can be found using our services are prohibited.
contributions to propaganda, religious and/or political opinion contributions or contributions containing information which in any way contains or concerns an incitement to racial hatred, child pornography or pornography, using our services are prohibited. It is also prohibited to defame, harass or insult others using our services.
If you have criticism or feedback about OHIOH.de or our services, please contact OHIOH.de first to help us improve our services.
You may not transfer and/or distribute any files that may damage OHIOH.de or the computers or property of others (e.g. viruses and trojans).
You may not share the personal information of others without their permission.
Your account.
You can delete/cancel/close your APP at any time.

You are responsible for your own health. OHIOH.de is not a medical or public institution and we do not provide medical advice or diagnosis. The purpose of the services is merely to help users to keep track of where they have been and to warn them in case of risk. Information provided through the Services and by our partners and affiliates is intended for research, pandemic preparedness and education purposes only. Always consult with your physician before making any judgements about your health.OHIOH.de cannot guarantee any results or improvements in terms of health risk assessment or chain of infection interruption. Our services are directed to adults only, please do not use our services if you are or may be suffering from a disease that could be aggravated by OHIOH.de. OHIOH.sw does not guarantee that the entries in our database are correct, reliable or complete. OHIOH.de or Tjark Ziehm is not liable for personal injury or other.

Our Pledge We as members, contributors, and leaders pledge to make participation in our community a harassment-free experience for everyone, regardless of age, body size, visible or invisible disability, ethnicity, sex characteristics, gender identity and expression, level of experience, education, socio-economic status, nationality, personal appearance, race, religion, or sexual identity and orientation. We pledge to act and interact in ways that contribute to an open, welcoming, diverse, inclusive, and healthy community. Our Standards Examples of behavior that contributes to a positive environment for our community include: * Demonstrating empathy and kindness toward other people * Being respectful of differing opinions, viewpoints, and experiences * Giving and gracefully accepting constructive feedback * Accepting responsibility and apologizing to those affected by our mistakes, and learning from the experience * Focusing on what is best not just for us as individuals, but for the overall community Examples of unacceptable behavior include: * The use of sexualized language or imagery, and sexual attention or advances of any kind * Trolling, insulting or derogatory comments, and personal or political attacks * Public or private harassment * Publishing others’ private information, such as a physical or email address, without their explicit permission * Other conduct which could reasonably be considered inappropriate in a professional setting Enforcement Responsibilities Community leaders are responsible for clarifying and enforcing our standards of acceptable behavior and will take appropriate and fair corrective action in response to any behavior that they deem inappropriate, threatening, offensive, or harmful. Community leaders have the right and responsibility to remove, edit, or reject comments, commits, code, wiki edits, issues, and other contributions that are not aligned to this Code of Conduct, and will communicate reasons for moderation decisions when appropriate. Scope This Code of Conduct applies within all community spaces, and also applies when an individual is officially representing the community in public spaces. Examples of representing our community include using an official e-mail address, posting via an official social media account, or acting as an appointed representative at an online or offline event. Enforcement Instances of abusive, harassing, or otherwise unacceptable behavior may be reported to the community leaders responsible for enforcement at [INSERT CONTACT METHOD]. All complaints will be reviewed and investigated promptly and fairly. All community leaders are obligated to respect the privacy and security of the reporter of any incident. Enforcement Guidelines Community leaders will follow these Community Impact Guidelines in determining the consequences for any action they deem in violation of this Code of Conduct: 1. Correction Community Impact: Use of inappropriate language or other behavior deemed unprofessional or unwelcome in the community. Consequence: A private, written warning from community leaders, providing clarity around the nature of the violation and an explanation of why the behavior was inappropriate. A public apology may be requested. 2. Warning Community Impact: A violation through a single incident or series of actions. Consequence: A warning with consequences for continued behavior. No interaction with the people involved, including unsolicited interaction with those enforcing the Code of Conduct, for a specified period of time. This includes avoiding interactions in community spaces as well as external channels like social media. Violating these terms may lead to a temporary or permanent ban. 3. Temporary Ban Community Impact: A serious violation of community standards, including sustained inappropriate behavior. Consequence: A temporary ban from any sort of interaction or public communication with the community for a specified period of time. No public or private interaction with the people involved, including unsolicited interaction with those enforcing the Code of Conduct, is allowed during this period. Violating these terms may lead to a permanent ban. 4. Permanent Ban Community Impact: Demonstrating a pattern of violation of community standards, including sustained inappropriate behavior, harassment of an individual, or aggression toward or disparagement of classes of individuals. Consequence: A permanent ban from any sort of public interaction within the community.
